Ligebehandlingsprincippet i EU's udbudsregler

Qualification, Selection and Exclusion in EU Procurement

af Steen Treumer (red.), Martin Trybus (red.)

This seventh volume of the European Procurement Law Series contains an in depth analysis of the qualification phase - exclusion, qualification, selection, and shortlisting. The topic is of crucial importance in EU tender procedures and has been considered in numerous disputes in the European Union. This volume supplements the fifth volume about the award phase. The book also considers the implications of the new public procurement directive with focus on the qualification phase and includes an analysis of the implementation of the new directive in a range of Member States.

The publication follows an original comparative approach covering diversified national approaches to EU public procurement law. It provides the reader with an insight that cannot be found elsewhere and includes specific chapters on the state of law and developments in France, Germany, United Kingdom, Spain, Italy, Portugal, and Romania. In addition, it contains a number of comparative chapters on specific issues of particular interest in theory and practice. The book will be a valuable tool for development of public procurement regulation and practice in the EU and is of interest to practitioners, national law makers, complaints boards, national courts, the European Commission and the Court of Justice and academics.

Modernising Public Procurement: The New Directive

European Procurement Law Series vol. 6
af Francois Lichére (red.), Roberto Caranta (red.), Steen Treumer (red.)

The recently approved Public Procurement Directive 2014/24/EU has brought a major overhaul to EU law and made significant changes to the obligations of contracting authorities in the Member States. Concurrently, the new directive has introduced some measures of flexibility and important new requirements. This book focuses on the essence of these changes, starting with the definition of a public procurement contract to end with changes to concluded contracts. In between many very important aspects of the reform are analysed, including the new rules on in house and public-public partnerships, on qualification, on the new and more flexible award procedures, including those aimed at fostering innovation. Specific attention is also paid to the new emphasis on strategic procurement, including to the benefit of SMEs, and to the renewed efforts to exploit e-procurement and aggregated purchasing.

The different contributions provide an in depth analysis of most of the new provisions in Directive 2014/24/EU and will be very valuable to academics and practitioners alike, especially considering that some of the new provisions may have immediate effects since to a large extent they codify the case law. Guidance in understanding how these provisions relate with the case law is therefore a necessity from now.

Award of Contracts in EU Procurements

European Procurement Law Series vol. 5
af Mario Comba (red.), Steen Treumer (red.)

The award phase is of crucial importance for the outcome of the competition for the contract and it is therefore not surprising that it has been considered in thousands of public procurement disputes in the Member States of the EU.

The subject of this book has for obvious reasons already received scholarly attention in the many books and articles on EU public procurement law. However, the existing literature has seldom been based on a comparative approach covering a broad range of Member States of the European Union with diversified national approaches to EU public procurement law. The present publication is original in this sense and consequently provides the reader with an insight that cannot be found elsewhere.

European Procurement Law Series vol. 3
af Steen Treumer (red.), Francois Lichére (red.)

The analysis provided in this book focus on the interpretation, implementation and practice in a range of Member States of the EU as enforcement mainly takes place at national level and on the recent changes introduced with Remedies Directive 2007/66.

It also considers the correlation between the available remedies, whether the different national systems all are leading to effectiveness, enforcement of the public procurement rules outside of the Public Procurement Directives and includes a general comparative study of the national enforcement regimes.

The In-House Providing in European Law

The European procurement Law Series Vol. 1
af Mario Comba (red.), Steen Treumer (red.)

This book focuses on the distinction between in-house and ex-house providing. The consequence of categorising an arrangement as in-house is that it falls outside the scope of the European public procurement rules.

The publication discusses the issue in a broader perspective and looks into the interpretation, implementation and practice in a range of Member States.
